This website (“Site”) is owned by Driving Solutions, LLC, doing business as The Informed Caregiver (“Company”). By accessing, using, and browsing the Site, you accept, without limitation or qualification, this Terms of Use Agreement each time you use our Site. You are also agreeing to the terms in our Privacy Policy.

Important: This Terms of Use Policy requires the use of arbitration on an individual basis to resolve disputes instead of a jury trial. By using our Site, you understand that you are waiving certain legal rights and are voluntarily agreeing to do so.

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY AND IN THEIR ENTIRETY, AS USING, ACCESSING, AND/OR BROWSING OUR WEBSITE CONSTITUTES ACCEPTANCE OF THESE TERMS AND CONDITIONS. If you do not agree to be bound by each and every term and condition set forth herein, please exit our website immediately.

Definitions

“Company”, “We”, “Our”, or “Us” means Driving Solutions, LLC, doing business as The Informed Caregiver. “Content” or “Program” means any and all written, visual, video, or audio information contained on the Site or provided as a link to our Content on other platforms/sites, including, but not limited to, blog posts, graphics, newsletters, designs, documents, information, templates, coaching guides, e-books, forms, webinars, photographs, and exercise programs. “You” or “Your” means a Visitor, User, or Customer. “Visitor” or “User” means any individual who accesses any Content on the Site. “Customer” means any individual who has purchased Content from us on the Site. “Personal Information” means information that can be used to identify, contact, or locate a person.

User License Granted

“User” of our Site is someone who has been granted access through a non-exclusive, non-transferable, revocable license to access and use our Site and Content strictly in accordance with this Agreement.

Our Services

Company has developed proprietary educational products and services (“Content”) offered through our Site.

Program Description

Company has developed a proprietary educational product on Successfully Care for Your Aging Loved One at Home. The educational Program consists of 12 lessons and a 90-minute online Coaching session for caregivers, plus access to a private Facebook Support Group. Company also offers virtual home safety training, virtual driver safety training, and caregiver coaching on an individual basis for a separate fee. Other Programs may be offered in the future at different payment rates and plans.

Your Use of Our Site

Use of our Site and Content is for internal, personal, non-commercial purposes only. Access is intended for Users 18 years or older. Any use by individuals under 18 is unauthorized and violates these Terms.

License Grant

If you purchase Content, Company grants you a non-exclusive, non-transferable license to access it through streaming, download, or email delivery, subject to the Intellectual Property Rights clause.

Our Relationship to You (Medical Disclaimer)

All Site and Content information is for educational purposes only and not intended as individualized medical advice. Your use of the Content does not create a patient or caregiver-provider relationship. Any use is at your own risk.

Facebook Groups

Some Programs may include a private Facebook group. Your participation is voluntary, and you acknowledge that posts are not private, even within private groups. We are not responsible for other members’ actions or for any content posted in the group.

All testimonials reflect personal experiences and opinions and are not guarantees of future results. They do not substitute professional medical advice.

Contact Page

If you contact us through our Site, you accept the inherent risks of email communication and consent to our use of your information to respond.

User Access to Content Purchases

When purchasing Content, you will create a Username and Password. You are responsible for maintaining confidentiality and for all activities under your login.

Prohibited Uses

You are prohibited from using the Site or its Content for unlawful, fraudulent, harassing, or infringing purposes, including but not limited to:

  • Uploading viruses or malicious code

  • Collecting others’ personal data

  • Spamming or scraping

  • Violating intellectual property rights

  • Discriminatory or defamatory behavior

  • Circumventing security measures

Right to Terminate

We reserve the right to limit or terminate your account at our discretion if you violate any terms or engage in prohibited use.

Payment and Purchases

All purchases are processed via Stripe. By purchasing, you authorize automatic payment charges. If payment fails, your access is terminated. We do not accept chargeback threats — such cases may be reported to credit agencies.

We are not responsible for the privacy or security policies of payment processors or any losses beyond our control.

Refunds

We generally do not provide refunds once access to the Content has been made available, unless otherwise stated in specific program details.

Intellectual Property Rights

All Site content — including videos, training materials, design, and code — is the property of The Informed Caregiver or its third-party providers. You are granted a limited, non-exclusive license for personal use only. Copying, redistributing, or modifying any material without written permission is prohibited.

Your License to Us

If you submit creative ideas or suggestions, you grant the Company full rights to use, reproduce, and distribute them without compensation. This does not apply to confidential personal information protected by law.

Digital Millennium Copyright Act (DMCA)

Dispute Resolution and Arbitration

You agree to binding arbitration before a single arbitrator under the American Arbitration Association Rules. Before arbitration, you must submit your concerns in writing via certified mail to:

Arbitration must be commenced within one (1) year of the incident.

Third Party Beneficiaries

These Terms benefit the Company, its affiliates, and licensors, all of whom may enforce these provisions directly.

Governing Law and Jurisdiction

This Agreement is governed by the laws of Massachusetts (MA).
If any provision is found invalid or unenforceable, the remaining provisions remain in effect.

Changes
